YOU might think that a speeding ticket is a speeding ticket - meaning that when you
get one you must pay up. But there are some situations where you can
get away with it. For example, when you take the driving test you
may be asked what is the speed limit if you do not see a sign with
the limit on it. The thing is that the actual limit is different according

Speeding ticket for a sign you did not see
When this is the case one of the most common situations is that the speed limit sign
was obscured by a tree or some brush. If that is the case going back
to the scene and taking a picture of the sign might be a helpful tool
towards your defense. You could argue that since you couldn't see
the sign, you had no idea
that you were traveling faster than the
permitted speed.
If you think the speed limit sign wasn't easy to see, you should photograph it as soon
as you can. The reason for this is that other people will complain
to the local authority that they were fined unfairly, and the problem
will be put right.Therefore you need to get those pictures to back
up your claim that you did not see the sign.
The police will probably try to argue that you are supposed to know the limits, and
that these apply even if there is no sign. This argument may be strong
enough to get you a fine - especially if you live locally - but your
evidence might reduce the fine, or let you get away with a caution.
A likely argument
to this type of defense is that although you weren't able to see the
sign, there are laws regarding speed limits if they are not posted.
This is a logical argument and although it won't help eliminate your
fine, it may help reduce it a lot because your fine will be based
on that in roads where there is no sign.
Iif you did not see the speed limit sign, and you do wind up with a ticket for going
too fast, it may have been because the sign was difficult to see.
If so, go back there, and if it is difficult to see - it might be
blocked by newly-grown trees or shrubs - take some pictures. This
could well help you beat the speeding ticket - or at least reduce
the fine - and you will help others avoid as well.
